When it comes to no pet housing the law protects those with ESA's. ESA’s are allowed into apartments and housing when the animal provides assistance related to the person’s mental disability. The owner of a home or building may not charge you any extra fees related to the pet such as pet rent or pet deposit.
Emotional support animals are allowed to live with you in campus housing or college dormitories. You will need verification from a licensed mental health expert.
Under the Air Carrier Access Act (ACAA), people can take their ESA with them on an airplane. The animal does not have to go in the cargo hold and can ride with the passenger. There are limitations to this so it is advised to contact an airline beforehand to know their policies.
Most people believe that an ESA can go anywhere with you in a public setting. Unfortunately, emotional support animals are not allowed in restaurants or other businesses such as grocery stores. Each business has the right to accept or deny your ESA. Its good practice to inform a store manager or employee that your animal is well behaved and your ESA.
Hotels and Air BnB’s are considered temporary housing therefore not required to allow emotional support animals. If you plan on staying at a hotel or Air BnB and wish to take your ESA please call them ahead of time and see if they can allow it.
Your ESA can be denied if you plan on traveling on a city bus or train. It is up to the driver or conductor to determine. Some trains like Amtrak will allow the animal however there are certain rules you must follow or at times even pay a fee.
Although there are many benefits to having an ESA with you in your workplace your employer is not required to accommodate the ESA. You can always speak to the manager and work something out if needed but make sure your animal is well trained and behaved.
